The Land and Environment Court has approved a 12 lot subdivision of the old Bangaloe Stud site at Kincumber.
The approval for the residential subdivision and associated works at 255, 255A and 255B Avoca Drive and 19 Picketts Valley Road, Kincumber, comes more than two years after the plan was submitted to Council.
The applicant went to the LEC with a deemed refusal and the first conciliation conference with Council was held in July 2024 with more to follow before agreement was reached this year; ratified by the court in May and the paperwork amended in June.
The area of 24.12 hectares is zoned C4 Environmental Living under the Central Coast Local Environmental Plan 2022 with the minimum lot area being 2 hectares.
One lot is 1.8 ha in area.
“Permitting proposed Lot 8 to be undersized achieves a regular subdivision pattern for the whole site with generous building envelopes for all of the dwelling lots and significant retention of vegetated areas and without having any adverse environmental impacts on the site and locality,” the judgement stated.
Community association property is 299 m2. .
Works will include

Infrastructure works internal and external to the site to create water, stormwater, sewer, electricity and NBN connections;

The construction of a private road internal to the site and relocation of existing vehicular access to Avoca Drive about 70m east of the current position;

Earthworks, filling and flood mitigation works;

Installation of water quality/quantity treatment devices;

Removal of vegetation; and
-
Landscaping.
The approval included a reduction in the total number of lots from 13 to 12; additional planting has been added to the landscaping treatment along the western boundary of the site to address privacy and overlooking concerns of a neighbour to the west of the site; a Vegetation Landscape Control Plan has been developed to establish and maintain vegetation outside of the Biodiversity Management areas in a way that maintains ecological value while managing bushfire risk; and the life of the Biodiversity Management Plan has been extended to increase the extent and duration of management activities.
An earlier proposal for a 202 site manufactured home community was refused by the Local Planning Panel in 2020 and a caravan park proposal was withdrawn in 2021.
